El ex ministro de Economía fue retirado en camilla y trasladado a un sanatorio. El juez destacó “la deliberada impunidad de los procederes” en el caso Gutheim, por el que fue detenido.
José Alfredo Martínez de Hoz, ex ministro de Economía de la última dictadura y símbolo máximo de la política que castigó “a millones de seres humanos con la miseria planificada”, como advirtió Rodolfo Walsh en marzo de 1977, fue procesado ayer con prisión preventiva por orden del juez federal Norberto Oyarbide por dos secuestros extorsivos que el magistrado calificó como crímenes de lesa humanidad, por ende imprescriptibles. La investigación judicial de los delitos que padecieron los empresarios Federico y Miguel Gutheim, forzados a renegociar desde la cárcel un contrato privado con comerciantes extranjeros en 1976, se interrumpió gracias a un indulto del ex presidente Carlos Menem que la Corte Suprema de Justicia declaró inconstitucional la semana pasada. Eduardo Luis Duhalde, titular de la Secretaría de Derechos Humanos, definió a Martínez de Hoz como el “jefe civil del golpe de Estado” y calificó la medida judicial como “una decisión histórica que implica reparar una de las más importantes deudas con la sociedad argentina”.
Martínez de Hoz vivió hasta ayer en el cuarto piso del edificio Kavanagh, en Florida al mil. Tal como había requerido la Secretaría de Derechos Humanos, Oyarbide decretó su “prisión preventiva de cumplimiento efectivo”. También le embargó sus bienes por dos millones de pesos. Los efectivos de Interpol que fueron a detenerlo con orden de trasladarlo a la división Delitos Especiales de la Policía Federal debieron esperar horas hasta que un equipo médico constató el estado de salud del anciano de 85 años, que según fuentes policiales se encontraba “postrado”. Finalmente fue retirado en camilla y trasladado en ambulancia al sanatorio De los Arcos.
En 1988 el juez federal Martín Irurzun procesó al dictador Videla y a sus ministros Martínez de Hoz y Albano Harguindeguy como coautores del secuestro extorsivo de los Gutheim. El economista estuvo más de dos meses preso en la Unidad Penal 22 de Viamonte a 1100. El 14 de julio de 1988 la Cámara Federal confirmó las preventivas de los militares, firmantes del decreto que ordenó las detenciones, y ordenó liberar a Martínez de Hoz, no por falta de indicios sobre su responsabilidad, sino porque a diferencia de los uniformados no había dejado sus huellas en el decreto. Los camaristas Gustavo Mitchell, Horacio Cattani y Juan Pedro Cotelezzi no concluyeron que Martínez de Hoz fuera “inocente” o “ajeno a la detención”, como el imputado afirmó el miércoles pasado en una solicitada. La investigación seguía abierta cuando Menem le perdonó sus delitos.
El proceso estuvo paralizado hasta mediados de 2006, cuando los organismos de derechos humanos solicitaron la reapertura de la causa y la declaración de inconstitucionalidad de los indultos, reclamo al que se sumó la SDH. El miércoles pasado se pronunció en tal sentido la Corte Suprema de Justicia, con votos de Ricardo Lorenzetti, Elena Highton de Nolasco, Juan Carlos Maqueda y Raúl Zaffaroni. El mismo día Martínez de Hoz manifestó mediante una solicitada que se siente víctima de “una persecución interminable” por parte del gobierno nacional. Incluyó entre los supuestos cómplices a la Justicia federal y a la Corte Suprema de Justicia, con “escasas y honrosas excepciones”. Duhalde solicitó su detención de inmediato. Oyarbide ordenó el viernes la prohibición para que el imputado saliera del país. Como Martínez de Hoz había prestado declaración indagatoria en los ’80, ordenó su detención sin necesidad de volver a indagarlo.
El juez destacó en su resolución, de treinta y tres fojas, “la deliberada impunidad de los procederes” que caracterizaron el caso de los Gutheim. También se refirió al “irrazonable empleo del poder coercitivo del Estado nacional sobre sus súbditos, las más absoluta desatención -plenamente consciente y determinada- a las esenciales garantías ciudadanas y el avasallamiento de todo principio constitucional”. En resumen, “la actuación de las máximas autoridades de la Nación disponiendo, según su parecer, designios y/o conveniencias políticas y/o personales, sobre la vida y la fortuna de las personas, al margen de toda regla de convivencia y del Estado de Derecho”, escribió.
Duhalde expresó su “profunda satisfacción” por la decisión judicial durante una conferencia de prensa, en el auditorio Emilio Mignone, en la que anunció la creación de una unidad especial de investigación de delitos económicos en la decretaría que conduce. El funcionario destacó que el procesamiento es “por su actividad delictiva y no, como ha pretendido el procesado en la insostenible solicitada publicada días atrás, por un afán de persecución interminable”. También recordó que “la dictadura cívico-militar produjo un verdadero genocidio económico al pueblo argentino” y consideró que Martínez de Hoz “representó a las facciones más concentradas del capital financiero, de los sectores industriales -como ex presidente de Acindar y la Italo- y como conspicuo miembro de los grandes terratenientes por su pertenencia a la Sociedad Rural Argentina”. Martínez de Hoz está imputado en otras dos causas judiciales por delitos durante la dictadura: una como jefe de la asociación ilícita que dio el golpe de Estado el 24 de marzo de 1976 y la otra por la desaparición de Juan Carlos Casariego de Bel, ex director del Registro de Investigaciones de la dictadura, secuestrado luego de oponerse a la estatización de la Compañía Italo Argentina de Electricidad.
SATISFACCIÓN POR EL ARRESTO
Representantes de organismos de derechos humanos coincidieron en ponderar la detención de José Alfredo Martínez de Hoz, a quien definieron como un emblema de la dictadura cívico-militar. “Fue uno de los responsables directos del genocidio, quizá más que Videla”, opinó Adriana Calvo, de la Asociación de Ex Detenidos-Desaparecidos (AEDD). Esa organización, junto con la Liga Argentina por los Derechos del Hombre, hizo hace cuatro años el pedido de imputación contra el ex ministro de Economía del último gobierno de facto. “Fue parte de los civiles partícipes de diagramar junto a las Fuerzas Armadas lo que fue la opresión de un pueblo”, dijo Estela Carlotto, presidenta de Abuelas de Plaza de Mayo, al expresar su satisfacción por la decisión judicial.
“Esperamos que los médicos que están evaluando su estado de salud certifiquen sin condicionamientos que si ayer paseaba por (la avenida) Santa Fe, hoy no puede estar enfermo”, agregó Carlotto. Para Taty Almeyda, de Madres Línea Fundadora, es “maravilloso” haber logrado “detener a este individuo que ha sido la cabeza del desastre económico y cómplice total de la dictadura”. Dijo Almeyda a Página/12 que las Madres “esperan que sea el inicio de un avance hacia los civiles, ahí está la esperanza, que se siga haciendo justicia porque los milicos no hicieron el golpe solos, hay una larga fila de civiles cómplices”.
La abogada Andrea Pochak, del Centro de Estudios Legales y Sociales (CELS), consideró que “cualquier persona tiene que rendir cuentas por los crímenes de lesa humanidad, esto no es una investigación política ni una revancha ideológica, sino una investigación penal y Martínez de Hoz está siendo investigado como responsable directo de un delito, haber sido partícipe de un secuestro”. Pochak hizo esta aclaración en respuesta a quienes piensan que el ex funcionario de la dictadura está siendo juzgado por su responsabilidad como ministro de Economía. “Se lo acusa de un delito aberrante, no por su responsabilidad en el sometimiento económico de un pueblo, lo cual sería fantástico, pero no es el caso, porque la Justicia investiga personas y delitos”, apuntó la letrada del CELS.
“Es un paso importantísimo y nos alegramos de haber conseguido que un personaje como Martínez de Hoz vaya preso”, dijo Calvo (AEDD). Sin embargo, la sobreviviente recordó que “hicieron falta 4 años y tres días desde la presentación de Justicia Ya! para que se anule su indulto, cuando al ex presidente Néstor Kirchner le hubiera demandado cinco minutos firmar un decreto para anular ese indulto”. Para Calvo, es probable que Martínez de Hoz no viva lo suficiente como para recibir su condena, porque “la causa recién empieza”, y lamentó que, en caso de ser sentenciado, “sólo sea por la privación ilegal de dos personas”. A su criterio, “en este país sólo se juzga a los que actuaron directamente en los hechos, no se juzga el genocidio, está claro que las órdenes las daba Martínez de Hoz a Videla”.
Por su parte, el abogado Rodolfo Yanzón hizo un reconocimiento “al que hizo la investigación”, el fiscal Ricardo Molinas. Y opinó que “esto nos tiene que abrir las puertas para discutir otro tipo de responsabilidad, y la relación directa entre delitos económicos, la picana, la capucha y los centros clandestinos de detención es el primer paso para empezar a discutir la responsabilidad de los civiles”.
DE LINAJE Y OTRAS "VIRTUDES"
En el cabildo abierto del 22 de mayo de 1810 participaron 225 personas; 79 se pronunciaron a favor del virrey Cisneros y contra los patriotas. Entre ellas, estaba el esclavista de gran fortuna José de María Martínez de Hoz.
A fines del siglo XIX, la Sociedad Rural financió la llamada Campaña del Desierto lanzada por el general Julio Argentino Roca para exterminar a los pueblos originarios y expropiarles sus tierras. El presidente de la Sociedad Rural era otro Martínez de Hoz, bisabuelo del actual, y por esa ayuda Roca le regaló 2.500.000 hectáreas en la Patagonia.
En 1975, José Alfredo Martínez de Hoz y otros directivos del Consejo Argentino Empresario visitaron al jefe del Estado Mayor, el general Jorge Rafael Videla. Trascendió que le pidieron “que contribuya a preservar el orden en las circunstancias que impiden la libertad de trabajo, la producción y la productividad”. En ese momento dirigía la empresa Acindar, que fue pionera del golpe con la represión de la huelga en su planta de Villa Constitución. El inspector de la Policía Federal, Rodolfo Peregrino Fernández, declaró que “Acindar pagaba a todo el personal policial un plus extra para convertir a la planta en una especie de fortaleza militar con cercos de alambre de púas”.
Nadie confirmó esa reunión del Consejo Argentino Empresario con Videla, ni se aclaró si allí efectivamente se habló del golpe del 24 de marzo o se empezó a planificar el disciplinamiento feroz de la sociedad para la aplicación de un nuevo plan económico. Pero la presencia allí del descendiente de esclavistas y de financiadores del genocidio indígena pasó a ser irrelevante cuando Videla, inmediatamente después de dar el golpe, lo designó como su ministro de Economía.
Que su antepasado José de María haya sido esclavista y votado en contra del proceso de la independencia, que su bisabuelo haya financiado la Campaña del Desierto y que él mismo haya presionado a Videla para dar el golpe genocida del ’76, no son delitos penados por la ley. Ni siquiera es delito haber financiado o empujado a los militares a una carnicería. La saga Martínez de Hoz no mató con sus manos, simplemente se benefició de lo que otros hacían.
Cuando lo nombró Videla, Martínez de Hoz no era nuevo en esas lides. Desde varios años atrás se había convertido en consejero económico de militares golpistas. Tener cerca una oreja de uniforme era parte del negocio y la política de la época. Había sido ministro en Salta por el gobierno militar que derrocó a Perón en 1955. Y después le había sido impuesto por los militares al efímero presidente José María Guido en los ’60.
El trazo biográfico es tan grueso que parece el villano clásico de una historieta. Ya son pocos los villanos así, Martínez de Hoz forma parte de una raza en extinción. Ahora no tienen prosapia y la sociedad no cede tan groseramente ese lugar de poder en la oscuridad, el lugar de los que hablaban con presidentes y generales para poner y sacar ministros, presidentes y generales, del que impone medidas para enriquecerse y solamente aparece en las páginas sociales, nunca en las de política.
Videla dio el golpe del ’76 en función de los intereses económicos que representaba Martínez de Hoz. Ese fue el verdadero motivo. Y la función del ex ministro es la más horrenda porque de allí se derivan todos los crímenes que se cometieron. Pero esa función no se castiga.
CONTRA LA IMPUNIDAD VIP
La detención del otrora ministro José Alfredo Martínez de Hoz reaviva el debate sobre la política económica de la dictadura, con toda lógica. Pero el ciudadano Martínez de Hoz no está siendo procesado por su ideología ni por las reformas que implementó. Se lo acusa de un delito de lesa humanidad cometido en el contexto del terrorismo de Estado. El sistema legal vigente habilita acciones penales si existen crímenes supuestamente comprobados. El acusado goza de todas las garantías del debido proceso, incluida la presunción de inocencia. La acusación a “Joe” no es una genérica imputación sobre su acción de gobierno: versa sobre el secuestro extorsivo de Federico Gutheim y su hijo. Un caso típico de uso de la maquinaria estatal como parte de un plan sistemático de represión y exterminio.
Ese caso es, a su modo, curioso aunque no único. La mayoría de los detenidos, encarcelados, asesinados o desaparecidos por la dictadura fueron trabajadores. Federico Gutheim, en cambio, era un empresario. Integraba un sector que en su mayoría instigó a la dictadura, la nutrió de cuadros, la avaló y la encubrió. Pero hubo situaciones en que la violencia estatal se descargó contra protagonistas del sector empresario o de las clases altas, mayormente embanderadas con el Proceso. Fernando Branca pagó con la vida ser el esposo de Martha McCormak, amante del genocida Emilio Massera. Los señores de la vida y la muerte en la ESMA también secuestraron y asesinaron a otros empresarios y se apoderaron de sus bienes.
Martínez de Hoz fue un ideólogo del régimen (acaso el principal) pero, a la hora de la hora, embarró sus guantes blancos, en un desborde de poder sin límite.
Un delito concreto lo coloca ante un juez. Se celebra su arresto pensando en muchas otras responsabilidades, inextricablemente ligadas pero jurídicamente diferentes.

El cronista interpreta que los objetivos de la dictadura trascendían a (eran más vastos y ambiciosos que) su plan económico. El proyecto era derruir la cultura política argentina, debilitar todas las formas de organización social, que eran muchas y aguerridas, desempatar la puja entre la clase trabajadora (eventualmente aliada a sectores medios) y los dueños del capital. Terminar con una sociedad de modales y demandas igualitarios o hasta jacobinos. Desmembrar el Estado benefactor que era su sustrato y revertir las conquistas laborales y sindicales, únicas en América del Sur.
El primer 2 de abril infausto de la dictadura fue el de 1976, cuando Martínez de Hoz enunció su programa económico, que contenía recetas consabidas, intentadas en ocasiones anteriores pero desbaratadas por la movilización popular. Los tecnicismos monótonos (Martínez de Hoz hablaba en voz baja e inexpresiva) se aderezaban con alusiones al “orden” y “la paz”, que iluminaban su afán: nuevos paradigmas para la política, nuevas reglas de comportamiento en la calle, en las costumbres cotidianas, en el arte, en las relaciones laborales. Sólo podían lograrse apelando a la violencia extrema, jamás irracional pues estaba centrada en toda la gama de los movimientos sociales y políticos. La masacre fue piedra basal de los cambios efectivamente logrados.

El apellido, la formación académica, el abolengo de los dueños de la tierra lo diferenciaban de tantos uniformados de apellidos inmigrantes sin garbo: Videla, Massera, Agosti, Viola, Galtieri. La condición civil, la proveniencia de clase, las generaciones que se sucedieron en la Sociedad Rural acentuaban el aura de impunidad de Martínez de Hoz.
Cuando se reabrieron los juicios contra los represores, se puso de moda comentar que pagaban “perejiles”: médicos, policías o soldados de bajo rango. La sucesión de sentencias y procesos desmiente esa impresión inicial, ya han sido condenados jerarcas militares. Quedaba exenta la pata civil, en especial la proveniente de clases dominantes añejas, habituadas a ser intocables e intocadas. La detención de Martínez de Hoz es, en ese aspecto, un salto cualitativo.
Otro lugar común de la derecha doméstica aduce que la búsqueda de verdad y justicia clava la mirada atrás, distrae del futuro, entorpece el progreso. Ayer fue un día simbólico que refutó ese concepto. Casi en simultáneo con la detención en la Cámara de Diputados se trataba la ley de matrimonio gay, un paso gigantesco en materia de igualdad en derechos civiles y humanos, una prueba de maduración de la sociedad. Que hayan ocurrido este martes es una casualidad, pero, piensa el cronista, hay una densa lógica histórica que explica la simetría de ambos avances, sólo imaginables (y aun así, tan trabajosos) en democracia.
