El juez Rafecas incorporó cuarenta casos de asesinatos, secuestros y torturas en la causa que investiga al dictador por la represión en el Primer Cuerpo. La mayoría corresponde a personas identificadas por el Equipo de Antropología.
El dictador Jorge Rafael Videla sumó más hechos a la acusación por la cual será juzgado en breve en juicio oral y público. Ayer el juez federal Daniel Rafecas lo volvió a procesar por otros 40 homicidios agravados, secuestros y torturas cometidos durante la dictadura militar, en el marco de la “megacausa” en la que investiga delitos de lesa humanidad cometidos en la órbita del Primer Cuerpo de Ejército. La mayoría de los hechos por los cuales el magistrado responsabilizó a Videla, en su condición de comandante en jefe del Ejército Argentino, corresponden a personas cuyos cadáveres fueron recientemente identificados por el Equipo Argentino de Antropología Forense.
Se trata de víctimas que habían sido enterradas bajo el rótulo de NN en diferentes necrópolis bonaerenses y en el Cementerio de la Chacarita en esta ciudad y que permanecían “desaparecidos” desde sus secuestros. Entre ellos se encuentra el caso del ciudadano alemán Rolf Stawowiok, un empleado de la editorial jurídica La Ley que fue secuestrado en el mes de febrero de 1978, por el cual la fiscalía alemana de Nuremberg tiene actualmente actuaciones abiertas contra Videla y solicitó la extradición del dictador para su juzgamiento. Los restos de Stawowiok fueron recuperados del Cementerio Municipal de Lomas de Zamora e identificados por los antropólogos forenses, “quienes constataron en los mismos vestigios que evidencian que fue ejecutado por sus captores”, según fuentes judiciales. El procesamiento dictado por Rafecas parece alejar la posibilidad de que Videla sea extraditado a algún país extranjero que lo reclama para juzgarlo por la desaparición de alguno de sus ciudadanos durante la dictadura. Esto es así porque el magistrado incluyó el caso de Stawowiok que Alemania reclama juzgar, pero esto queda diluido por el “principio de territorialidad”.
Videla, ex presidente de facto y ex teniente general del Ejército, fue procesado por ser considerado autor de 37 homicidios agravados, 41 privaciones ilegales de la libertad agravada por mediar violencia o amenazas y tres casos de aplicación de tormentos. Además, el juez le dictó un embargo de cinco millones de pesos sobre sus bienes. En la resolución de 476 páginas, Rafecas detalló cada uno de los casos que se le imputan a Videla y sostuvo que “quedó acreditada la organización y funcionamiento de una estructura ilegal, orquestada por las Fuerzas Armadas, la cual tenía como propósito llevar adelante un plan clandestino de represión”.
El dictador, de 85 años, está arrestado en una cárcel dentro de un cuartel del Ejército por numerosos casos de delitos de lesa humanidad. En diciembre, el juez Rafecas dispuso la elevación a juicio oral de Videla por otros 600 crímenes a los que ahora se agregan estos nuevos hechos, y será juzgado por el Tribunal Oral Federal 1 de Capital. Además la semana pasada la Corte Suprema de Justicia declaró inconstitucional un indulto dictado en su favor en 1990 en una causa por el secuestro de dos empresarios.
Pero ahí no termina el periplo judicial del dictador, porque este mes volverá a sentarse en el banquillo en la provincia de Córdoba en una causa por el fusilamiento de 32 presos políticos en cárceles de esa provincia entre abril y octubre de 1976. Será la primera vez que Videla vuelva a enfrentar un tribunal desde que fue juzgado y condenado en 1985 en el histórico Juicio a las Juntas. En aquella ocasión fue condenado a prisión perpetua y luego indultado, pero en 1998 volvió a prisión, primero domiciliaria y luego efectiva, acusado de robo de bebés. De hecho, por esa causa, Videla, el último presidente de facto, Reynaldo Bignone, y otros genocidas serán juzgados a partir del 20 de septiembre, imputados por 33 casos de robo de menores, en lo que se conoce como el expediente sobre el plan sistemático de apropiación de menores durante la dictadura.
