SANTA FE. JUICIO, TESTIMONIOS Y LAS CONDENAS AL EX- JUEZ BRUSA Y LOS OTROS REPRESORES

Se respetaron todas las garantías constitucionales

"El juicio fue ejemplar" .

Los fiscales Martín Suárez Faisal y José Ignacio Candioti ponderaron el debate público que concluyó con el primer juez federal de la Argentina condenado por crímenes de lesa humanidad. Víctor Brusa resultó culpable de ocho casos de apremios ilegales y sentenciado a 21 años de cárcel, mientras que cinco ex policías que compartieron el banquillo deberán purgar condenas por secuestros y torturas de 23 a 19 años de prisión: Héctor Colombini y Eduardo Ramos (23 años), Juan Calixto Perizzotti (22), Mario Facino (20) y la ex carcelera María Eva Aebi (19). Todos cumplieron distintos roles en el circuito de la dictadura en Santa Fe, pero en el marco de "un plan sistemático de represión y exterminio", señaló el veredicto. "Brusa actuaba como delegado del juez en los centros clandestinos de detención", acotó el fiscal.

El juicio a Brusa y compañía se extendió tres meses, declararon cien testigos y se inspeccionaron centros clandestinos emblemáticos como la comisaría 4ª (que estuvo a cargo de Facino hasta fines de 1976) y la Guardia de Infantería Reforzada (donde operaban Perizzotti y Aebi).

"Estamos muy conformes con el veredicto", expresó Suárez Faisal. "El trámite fue correcto y la organización del juicio muy buena y eficaz. Y lo más importante: se respetaron todas las garantías constitucionales y el debido proceso, tanto a los imputados como a las víctimas. Incluso, el tribunal (integrado por el juez Roberto López Arango y los conjueces Andrea Creus y Carlos Renna) admitió pruebas aún fuera de la etapa oportuna para garantizar a ultranza y al máximo, el derecho de los acusados a presentar todos los elementos que consideraban necesarios para fundar sus defensas".

"Ha sido un juicio ejemplar que respetó todos los derechos y garantías de las partes y al que se arribó a una sentencia condenatoria que fue compatible con los pedidos que había hecho el Ministerio Público y las querellas", agregó Suárez Faisal.

Los fiscales acusaron por 56 hechos. El tribunal consideró probados 54, sólo desestimó dos imputaciones por fallas procesales. Y condenó por esos 54 hechos, con el mismo molde que había planteado el Ministerio Público.

"Nosotros estudiamos la situación de cada imputado, valoramos las penas que correspondían por los hechos que se le atribuyeron y formulamos el petitorio", dijo Suárez Faisal. En su alegato, el fiscal pidió penas de 25 a 23 años de prisión y en el veredicto, el tribunal mantuvo la misma graduación, pero la redujo de 23 a 19 años. "Los jueces adoptaron el mismo molde, la misma referencia que tuvimos nosotros para pedir las penas", explicó.

Esta es la primera condena a un ex juez federal. ¿Qué se siente?

Nosotros consideramos que no sólo hubo un daño a las víctimas, sino también a la justicia desde el punto de vista institucional. El Poder Judicial tenía que ser el órgano del Estado encargado de garantizar el debido proceso y el derecho de las personas, aún en la dictadura. Pero eso no ocurrió. A partir de la intervención de Brusa, esa función se desdibujó totalmente y lo más grave es que las personas que él apremió ya eran víctimas de una privación ilegal de la libertad y tenían signos evidentes de torturas, entonces no pudieron ser revisadas por una autoridad judicial como sí ocurrió en otros casos. Brusa actuaba como delegado del juez en los centros clandestinos de detención "dijo Suárez Faisal.

Eso concuerda con un documento de la Side que se ventiló en el juicio y define a Brusa como "amigo y colaborador del Ejército".

Es un documento que se encontró en el Archivo Ideológico. Lo firma un funcionario de la Side, (ya fallecido, el teniente coronel), Rondello Barbaresi. Y dice que Brusa había "colaborado estrechamente en la llamada lucha contra la subversión" y que era "amigo y colaborador del Ejército". No sabemos por qué se redactó ese documento, pero suponemos que ya en 1981 fue propuesto por alguna autoridad militar como posible juez federal de Santa Fe, según surge de una anotación manuscrita que hay en el mismo informe de inteligencia. Pero Brusa no llegó al cargo por oposición del ministro de Justicia de esa época (Alberto Rodríguez Varela) "respondió Suárez Faisal.

¿La condena desploma la teoría de los perejiles?

La teoría de los perejiles, como la llama usted, no puede ser admitida de ninguna manera. Porque en todos los casos se trataba de funcionarios que tenían a su cargo dependencias muy significativas como instrumentos de persecución durante la dictadura militar. Facino fue el jefe de la comisaría 4ª, que era la puerta de entrada del circuito represivo de Santa Fe y Perizzotti era jefe (de la Oficina Coordinación del Area 212) en la Guardia de Infantería Reforzada. En este juicio estuvieron los dos responsables de la peor época de estos dos centros clandestinos y de la represión en Santa Fe. Y también dos integrantes de los grupos de tareas como Colombini y Ramos que tuvieron mucha participación en diversos de casos de privación ilegítima de la libertad.

Pero hubo un desguace del juicio. No llegó ningún militar. La asociación ilícita fue desglosada en otro expediente. Y hasta se desmembró el caso del secuestro y desaparición de Alicia López en el que Facino está imputado por homicidio. ¿Por qué?

El trámite de este tipo de causas es engorroso y dificultoso. Hay muchos imputados, muchas víctimas y muchos hechos. Distintas posibilidades de acción y mucha dificultad en la recopilación de la prueba. Esto hace que el trámite de estos expedientes sea sumamente complejo y difícil. Y muchas veces se llega a juicio con la cantidad de hechos que se puede y no con todos los que se hubiera podido llegar si la investigación hubiera sido más cercana en el tiempo. De todas maneras, desde la Procuración General de la Nación se hace un trabajo muy importante respecto de la recopilación de datos y el seguimiento y coordinación de las causas. Eso ha dado muy buenos resultados, al punto que se acumularon varias causas en la que se investigan 46 muertes producidas durante la dictadura. Es una investigación que está avanzando a buen ritmo.

En el alegato, usted pidió que se inicien más investigaciones.

Es una cuestión que deberá evaluar el fiscal de primera instancia, escuchar las declaraciones y decidir si se iniciarán investigaciones a personas que pueden estar involucradas en hechos ilícitos. Nosotros, como representantes del Ministerio Público tenemos la obligación de promover las investigaciones de todos los hechos que conocemos por nuestra tarea- concluyó Suárez Faisal.

Una cuestión de género

"Cuando se trataba de mujeres en la metodología de los represores se agregaba a las torturas físicas y psíquicas una violencia específica de contenido sexual", dice el texto de un alegato presentado en la causa Brusa. De hecho, no fue hasta la década del `90 -en los genocidios de Ruanda y Bosnia- donde se incluyeron por primera vez las violaciones como delitos de lesa humanidad, cuando fueron cometidos en esos marcos de violencia política.

El alegato presentado en la Causa Brusa por las abogadas Leticia Faccendini y Jésica Pellegrini, integrantes de la Liga Argentina por los Derechos del Hombre de la provincia de Santa Fe y patrocinantes en la querella de José Schulman y Patricia Isasa; incluye el señalamiento de los hechos y el correspondiente reclamo con especial atención hacia la cuestión de género. "También quedó probado que cuando se trataba de mujeres detenidas desaparecidas, en la metodología de los represores se agregaba a las torturas físicas y psíquicas una violencia específica de contenido sexual, manoseos y distintas formas de abuso sexual, violaciones y amenazas de violaciones masivas", dice el texto.

El mismo alegato proporciona algunos datos interesantes para poder pensar en la importancia del planteo: la violación no fue mencionada en la Convención contra el Genocidio de 1948 pero la extensión, frecuencia y evidencia del acto de violación en procesos de genocidio hicieron necesario que los Tribunales internacionales especiales reformularan esas concepciones, tal el caso del que se constituyó por Rwanda, en 1998, cuando el fiscal que actuó decidió incluir la violencia sexual y la violación a mujeres y niñas como parte del genocidio. Y además cita que las actuaciones de los Tribunales ad hoc de Bosnia y Rwanda representan cambios determinantes en el modo en que es concebida la violencia sexual como crimen de lesa humanidad o genocidio. Se trata del primer momento en que la violación hacia mujeres y niñas es caracterizada como crimen de lesa humanidad ya sea en conflictos nacionales o internacionales. Implica una inclusión de la violencia sexual como crimen en la Convención de Ginebra y en el protocolo Adicional II. Concebir los actos de violencia sexual y las violaciones como delitos de lesa humanidad y parte de la planificación del genocidio implica que los perpetradores de esos crímenes no puedan gozar de impunidad.

Una de las testigos en el juicio que terminó hace poco en la capital provincial y que condenó al ex juez federal Víctor Brusa, a habló de tortura sexual en la sala de audiencias, pero ninguno de los represores fue condenado, especialmente, por los delitos cometidos contra mujeres y también contra menores por ser tales, niñas, niños y adolescentes. Isasa es una de estas víctimas, tenía 16 años cuando fue secuestrada, también lo fue Josefina González quien tenía 5 meses cuando fue secuestrada junto a su madre Rut, luego asesinada. Y lo fueron Graciela Roselló y Marta Bertolino que junto a González hablaron con este diario. Por supuesto que no es fácil abordar el tema, no es un aspecto de tratamiento común entre las víctimas, casi podría decirse que hay un "aguantarse" individual en el que cada una hizo lo que pudo con su experiencia. Así lo muestra el testimonio de Roselló cuando narra que tuvo que trabajar durante un largo tiempo en terapia "porque a medida que se acercaba el juicio uno sabía que lo privado, de pronto pasaba a ser público. Ni bien salí liberada preservé a mis padres de ese/este dolor y hasta ahora había preservado a amis hijos" y cuenta una anécdota familiar a partir de una discusión entre sus hijos, Mariana (29) y Javier (26). El joven le recriminaba a su hermana porque no había entrado a presenciar el testimonio de su madre y esperó en la puerta. La chica le dijo: "Ya sé que a vos también te dolió escuchar el relato de mamá, pero no entendés del todo, yo soy mujer". Es cuando Roselló reflexiona: ahí sentí la magnitud entre lo que es privado y que es importante hacer público para poder juzgar y condenar. Y aquí hubo otro plus, la angustia de mi hija mujer al no querer escuchar lo que imagina o que sabe aunque nunca fue enunciado por mí".

Cuando Roselló señala especialmente que la Causa Brusa fue la primera que incluyó el juzgamiento a una represora, María Eva Aebi, la carcelera de 56 años, la testigo, hoy dirigente sindical bancaria e integrante de la dirección de la CTA Rosario dice: "Tiene sólo dos años más que yo pero en mi recuerdo la tengo como una mujer que me llevaba algo más de diez años, tal vez por su postura de poder ante nosotras "los cerrojos que poseía y el arma que ostentaba con la que simuló fusilamiento hacia varias compañeras. Ella me llevó a la comisaría 4ta., me entregó y cuando me retiró yo no estaba en las mismas condiciones en que me había dejado. Ella es tan culpable como el que usaba la picana y la tortura sexual. Cuando salí de la Guardia de Infantería Reforzada lo hice convencida de que no quería traer hijos a este mundo. Es que había caído una compañera de Reconquistas, Alba Azulay, a la que torturaron con su bebé en la propia 4ta., poniendo al niño cabeza abajo, dejándolo llorar horas enteras cuando tenía hambre, sin arrimarlo al pecho de su madre. Los pechos de Alba rebozantes y el niño como rehén" después, cuando salí pude ser mamá y ahora pienso que no nos pudieron doblegar".

Josefina Victoria González lleva, junto a sus nombres emblemático por su padre José el primero y por la victoria de él mismo el segundo , muchos, muchísimos dolores. A pesar de ello tiene una mirada azul celeste serena. Cuando el miércoles pasado compartía un café con esta cronista,l por la mañana, tuvo que soportar otra vez, por la tarde, la violación de su domicilio y el secuestro de algunas copias del expediente que se sigue en Rosario por la megacausa Feced en la que ella declarará.

Josefina habla de sí misma y de su madre Rut. Su relato engloba todas las figuras contenidas más arriba sobre el especial ataque a mujeres y menores. Esta beba de 5 meses estaba junto a su hermana Mariana, de 3 y el lugar que les habían asignado era el baño del subsuelo. Allí las dejaban cuando las separaban de Rut y allí las iban a buscar cuando querían que presenciaran algún interrogatorio. En realidad lo que las "bestias" buscaban era que Rut viera a sus hijas mientras la torturaban y vejaban. Josefina tiene imágenes brutales, una de ellas de su madre en una camilla rodeada por hombres, luego gritos a los que, dice, seguía la violación. Rut González fue asesinada junto a su hermana Estrella y la pareja de esta última el 5 de octubre de 1976, pero además Josefina soporta en toda su humanidad la pérdida de sus abuela materna, Amorosa secuestrada y luego asesinada, en Buenos Aires entre junio y octubre de 1977. Amorosa al igual que el padre de Josefina, Dardo José Tosetto, continúan desaparecidos. El fue secuestrado el 9 de diciembre de 1975 cuando Rut y sus chicas empezaron el periplo para esconderse hasta que son atrapadas en casa de Pedro Paulón, el hermano de dirigente metalúrgico Victorio Paulón, en Sánchez de Bustamente 845. La otra tía de las chicas, María de las Mercedes fue secuestrada en septiembre de 1975 y asesinada, en el "78 o "79. Josefina no recuerda con excactitud.

"La sociedad, en general, le pone un plus a todo lo que la mujer hace y en el cautiverio no dejaba de reproducirse esa concepción. Es como si nosotras necesitáramos en la vida común de un hombre al lado, cuando en general podemos decirle a ellos cómo hacer bastantes cosas. Cuando recuerdo a mi madre y a tantos tipos sometiéndola en tantos sentidos, me doy cuenta que ella encontró la manera de que no le partieran el alma. Estoy orgullosa de ella", dice la Tana, como todos la conocen. También cuenta que producto de golpes y maltratos ella perdió el bazo y también le falta un pedacito de una de sus orejas. Las secuelas para las niñas cuando ya estuvieron con su tía abuela que la crió fueron durísimas.

La estrategia genocida que incluía el ataque por género abarcaba a las criaturas. Por eso la hoy psicoanalista, profesora de análisis institucional en la Facultad de Psicología de la UNR habla de su estada forzoza y su condición de sobreviviente del Servicio de Informaciones de la Jefatura de Policía de Rosario. "Me tocó dar a luz en la más absoluta indefensión bajo la advertencia de que mi bebé, una vez nacida "si es que llegaba a nacer , desaparecería y que ninguno de nuestros seres queridos sabría nunca de nosotras. Me habían advertido que luego del nacimiento me seguirían "interrogando" como venían haciéndole hacía más de 20 días en la sala de torturas del Servicio de Informaciones. Bertolino ubica su situación en el contexto general del asesinato, la sustracción de bebés y la tortura sistemática. También dice que la crueldad "hinca sus garras en los sitios que detecta más vulnerables y los genocidas autóctonos no se privaron de ejercer ninguna de sus formas. Sería imposible, además de absurdo, intentar organizar por grados o jerarquías la ignominiosa lista de crueldades, pero sin duda una de las escenas más crueles que podamos imaginar es la de una mujer sacudida por los dolores de parto en un campo de concentración, atravesada por la angustia desgarradora de no poder proteger a su cría, inerme ante la mirada del verdugo que habrá de disponer de ambas sin que ninguna ley le ponga freno".

En cuanto a los niños nacidos de madres en cautiverio "sometida a tortura es lisa y llanamente un niño cautivo, un niño torturado. La tortura es el paradigma de un avasallamiento radical, el escenario más antagónico que podríamos pensar con respecto a las condiciones básicas de acceso a la cultura".
